FERC issued a show cause order in July against Amaranth, alleging market manipulation of natural gas prices and proposing penalties totaling $291 million. In response to FERC's enforcement action, Amaranth has argued to the Court its futures trading activities are beyond the jurisdiction of FERC, as only the Commodity Futures Trading Commission (CFTC) has enforcement authority in this area. FERC has maintained that the new enforcement provisions in the Energy Policy Act of 2005 provide it the authority to prohibit manipulation, not only by direct participants in the physical power and gas markets, but also where any entity manipulates financial markets and such activity directly or indirectly impacts the price of Commission-jurisdictional transactions. Amaranth seeks to have the Court enjoin the FERC enforcement proceeding, citing the burden and expense of defending its conduct in two separate proceedings at the same time. APGA, APPA and NRECA, however, respond that the two agencies (CFTC and FERC) are enforcing two different statutes, and it is commonplace for entities accused of wrongdoing under two different statutes to defend their actions in simultaneous proceedings. As groups representing community- and consumer-owned utilities, APGA, APPA and NRECA generally support both agencies exercise of jurisdiction. They believe the intent of Congress in providing FERC with its new anti-manipulation authority in the Energy Policy Act of 2005 was to provide consumers with an additional measure of protection.

FERC Form is Outdated, APPA Tells Commission (03/28/2007)
The Federal Energy Regulatory Commission should continue to collect detailed financial information from investor-owned utilities, but make some discrete changes to make its Form 1 more useful, APPA said. The information on Form 1 is used by customers, state regulators and consumer advocates to monitor whether cost-based rates for transmission and/or wholesale power remain just and reasonable, but often Form 1 does not include all of the information needed to make the necessary calculations, APPA said in March 28 comments to FERC.
